$PEGA very good news out of Virginia Supreme Court.
The Supreme Court of Virginia has issued a unanimous decision affirming the judgment of the Court of Appeals. As a result, the prior
$2 billion verdict remains vacated, and the matter is remanded for a new trial on the claims of alleged trade secret misappropriation and, if liability is established, damages.
In its decision, the Supreme Court agreed with the Court of Appeals that the trial court committed several procedural errors, including the improper allocation of the burden of proof on damages, limitations on rebuttal damages evidence, restrictions on the use of software demonstrations, and limitations on evidence concerning access to the alleged trade secrets.
