$CAUD The United States District Court for the Southern District of New York issued an order adopting a report and recommendation in Bordes v. Deveaux (23 Civ. 7430). Plaintiff Peter Bordes, Jr. sued Defendant Marc Deveaux for defamation per se, defamation, and intentional infliction of emotional distress, alleging that Deveaux made three defamatory LinkedIn comments about him. The court, adopting Judge Jennifer E. Willis’s recommendation, granted Deveaux’s motion for summary judgment and denied Bordes’s cross-motion for partial summary judgment. The court found that the statements were either substantially true or non-actionable opinions and dismissed Bordes’s emotional distress claim, ruling that the conduct was not "extreme and outrageous." Additionally, the court denied Bordes’s request for a permanent injunction, as it was not an independent cause of action. Judgment was entered in favor of Deveaux, and the case was closed.
