$NEON $SSNLF Samsung seem to have missed the deadline to appeal to the Supreme Court. The 879 patent’s validity is thus definitely and conclusively upheld! Judge Albright could then sign the amended scheduling order for the upcoming jury trial in Texas, which he have just done today.

@Rafatops didn’t move on the massive victory after Micron. Correction, it moved down 25%. After PTAB started to finalize their suggestions of invalidity it put a massive kink in how this operates and it’s hard to know where there will be relief until CAFC affirms these patents next year. Worth the wait and I’m very excited to get to CAFC. However even without a bump to price, a court victory win against Samsung will only further reinforce how big of a rise we get compounded together when the affirmations occur. $NEON jumped $2 - $12 in a day when CAFC affirmed their patents a couple months back.

$NEON Today marks 90 days since the Fed's reverse order and last day for Samsung to file an appeal to the SC. <1% of cases are heard and reversed by the SC. An appeal to the SC will not impact the schedule in Texas. If they don’t file however, the pressure on $SSNLF to settle increases!

The lawsuit, which also involves Google, could see resolutions by mid-2025. Industry analysts believe that Neonode has an 85% chance of reaching a settlement with Samsung, which could amount to $31 per share for Neonode. The case against Apple, however, is expected to be more challenging, with a lower probability of success due to the case being held in California, a jurisdiction known to favor large tech firms. $NEON As many times as Apple and Samsung have been slapped down, and clearly embarassed by courts; I am surprised they persist to challenge this patent. Susman Godfrey has over 150 lawyers working on this. It's a no win for the infringers.

$NEON This increases the value of the case against Samsung substantially. Now treble damages are available also for Samsung devices sold between 2014-2020, which is about half of all the devices included in the suit. The damages for half the devices in the suit against Samsung $SSNLF increased by up to 3x! $AAPL is next with the upcoming trial in California. World wide sales of all iPhones and iPads between 2014-2026 are included in that suit, leading to potentially largest damages ever in a patent suit.

$NEON The HUGE news that mostly went under the radar from $SSNLF Samsungs filing in court last week, is that Samsung admitted that they knew about Neonode's 879 patent already in early 2012! Hello willful infringement and treble damages now available for ALL Samsungs sold devices from 2014-2026. Judge Albright had previously ordered that willful infringement was only available from the filing date in 2020, since Neonode had not proven that Samsung knew about the 879 patent before that. But now Samsung have admitted to just that.

We also learned that Fact Discovery has started and has been going on since a month already! Time is running out for Samsung, they need to settle or will lose the maximum amount in the jury trial. Trial against $AAPL in California is up next.
